Terms and Conditions -Inspire to Aspire Events Ltd. 

 

 

Trading as the ITAE Group offering: Anatomy Lab LIVE, Operating Theatre Live, The VIVIT Experience and The Murder Trial Live. Application and entire agreement 

 

  • These Terms and Conditions apply to the provision of the services detailed in our quotation (Services) by Inspire to Aspire Events Limited trading name (we or us) to the person buying the services (you). 

  • You are deemed to have accepted these Terms and Conditions when you purchase a booking confirmation, ticket or make a first stage payment for the event, which will form the contract between us and you.

  • You acknowledge that you have not relied on any statement, promise or representation made or given by or on our behalf. These Conditions apply to the contract to the exclusion of any other terms that you try to impose or incorporate, or which are implied by trade, custom, practice or cause of dealing. Interpretation 

  • A “business day” means any day other than a Saturday, Sunday or bank holiday

  • The headings in these Terms and Conditions are for convenience only and do not affect their interpretation. 

  • Words imparting the singular number shall include the plural and vice-versa. 

 

Services 

 

  • We warrant that we will use reasonable care and skill in our performance of the services which will comply with the ticket price including any specification in all material respects. We can make any changes to the services which are necessary to comply with any applicable law or safety requirement, and we will notify you if this is necessary. 

  • We will use our reasonable endeavours to complete the performance of the Services within the time agreed or as set out in the event description, however time shall not be of the essence in the performance obligations. 

  • All of these Terms and Conditions apply to the supply of any goods as well as services unless we specify otherwise. 

 

Your obligations 

 

  • You must obtain any permissions, consents or licenses or otherwise that we need and must give us with access to any and all relevant information, materials, properties and any other matters which we need for you to attend the event. 

  • If you do not comply with the above clause we can terminate the reservation without refund. 

  • We are not liable for any delay or failure to provide the event to you this is caused by your failure to comply with the provisions of this section (Your obligations).

 

Fees 

 

  • The fees (Fee) is the amount shown in British Pounds (£ -Sterling) or other local currency indicated on the booking confirmation. 

  • The fee must be paid in full before the nominated time specified by us or we reserve the right to cancel the booking without refund.

  • If due to circumstances beyond our control, including those set out in the clause below (Circumstances beyond a parties control), we have to make any changes to the event or how they are provided, we only notify you if this has a major impact on the event. We will use reasonable endeavors to keep any such changes to a minimum

 

Payment 

 

  • We will supply you with confirmation of your booking once we have received payment. 

  • You must pay the complete amount in full for the booking confirmation to be valid in accordance with any credit terms agreed between us.

  • Time for payment shall be the essence of the contract. 

  • If payment in full is not received the booking quotation shall be treated as if it never existed and any details or Services in the offer will not be valid. 

  • Receipts for payment will be issued by us only at your request. 

  • All payments must be made in British Pounds (£ -Sterling) unless otherwise agreed in writing by us. 

  • Booking fee protection is only valid if purchased at the same time and within the same transaction as purchase of ticket.

 

Refund/Cancellations 

  • The ITAE Group operates a strict no refund or transfer policy on all tickets once purchased. Occasionally the ITAE Group may offer a refund to guests should the event be cancelled or postponed due to circumstances beyond our control. As per your consumer rights, you are entitled to a refund of the face value or any tickets purchased in associated with the event that that been cancelled or postponed. Should an event be affected by a cancellation or postponement, you will be notified by email using the email address inputted during the transaction. Please note, it is your responsibility to enter an accurate email address and ensure your mail box settings are updated to receive ITAE Group email correspondence. We advise you to monitor your general mailbox as well as spam and junk folders on a regular basis. You will have 7 days from the date of the email to contact our guest experience team using the online process as set out in our correspondence. Please note that refund request can take 14 days to be processed and 14 days to be credited back into your account. Booking fees are non refundable unless covered by the optional booking fee protection. 

Admission

  • Management reserve to right to refuse admission without explanation and refund.

 

Intellectual property 

  • We reserve all copyright and other intellectual property rights which may subsist in any goods in connection with the provision of the Services. We reserve the right to take any appropriate action to restrain or prevent the infringement of such intellectual property rights. The event will be covered by photographers who will take still, recorded and drone footage of the event. Inspire to Aspire Events own the copyright and IP in connection with any photograph taken at the event and reserves the right to use this for marketing and promotional purposes. Guests attending will not take any recorded footage of the event but are however permitted to take their own photographs. The exclusive ownership of IP and copyright also extends to any images taken by a guest, journalist or third party. 

 

Liability and indemnity 

 

  • Our liability under these Terms and Conditions, and in breach of statutory duty, and in tort or misrepresentation or otherwise, shall be limited as set out in this clause. 

  • The total amount of liability is limited to the total amount of Fees payable by you under the Contract. 

 

Circumstances beyond a parties control

 

  • Force Majeure, we are not liable for any failure or delay in performing our obligations where such failure or delay results from any cause that is beyond our reasonable control. Such causes include but are not limited to: power failure, structural damage, Internet Service Provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of the party in question. Every attempt will be made to reorganise the event within 684 days. Reorganised events will not include food or drink unless stated. Where Force Majeure occurs Inspire to Aspire Events will postpone events without refund. but will instead offer credit notes.

 

Communications 

 

  • All notices under these Terms and Conditions must be given in writing and signed by, or on behalf of, the party giving notice (or duly authorised officer to the party). 

  • Notices shall be deemed to have been given duly given: 

  • a) When delivered, if delivered by courier or other messenger (including registered mail) during the normal business hours of the recipient; 

  • b) When sent, if transmitted by fax or email and a successful transmission report or return receipt is generated; 

  • c) On the fifth business day following mailing, if mailed by national ordinary mail; or 

  • d) On the tenth business day following mailing, if mailed by airmail. 

Liability

  • Our liability under these Terms and Conditions, and in breach of statutory duty, and in tort or misrepresentation or otherwise, shall be limited as set out in this clause. 

  • The total amount of liability is limited to the total amount of Fees payable by you under the contract. 

  • Commercial Cap in Respect of Liabilities: Notwithstanding anything expressed or implied in this Agreement to the contrary, the ITAE Groups maximum aggregate liability to you for all liabilities related to this Agreement, in contract, tort (including negligence or breach of statutory duty), delict or otherwise howsoever arising, shall not exceed a sum equal to the Fees payable under this Agreement. 

Insurance and claims

  • Inspire to Aspire Events Limited will be insured through its usual public liability insurance covering the groups operations. Any claims in respect of this event should be directed to our registered head office where they will be dealt with accordingly. The ITAE Group will provide trained first aid staff and have access to 999 emergency services at all times. Ticket holders engage with the ITAE Group at their own risk and the ITAE Group accepts no liability or responsibility for death, harm or injury caused by participation in any part of our events.

  • Inspire to Aspire Events Limited will provide a risk assessment and all documentation and where required have seeked approval from the local authority and its stakeholders. Supervision of minors is conducted inline with our safeguarding policy which is available by request from our DSO. 

  • All action plans for emergencies, evacuations etc.; will be approved in accordance with the local authorities recommendations or guardians. 

  • All staff will be trained and residents, volunteers etc.; will be briefed on the appropriate action to take should such necessary emergency action have to be taken. 

 

Law and jurisdiction 

 

  • These Terms and Conditions are governed by and interpreted according to English law. All disputes arising under these Terms and Conditions are subject to the exclusive jurisdiction of the English courts.
